Финансовый регулятор Гонконга «Комиссия по ценным бумагам и фьючерсам» (SFC) объявил, о запрете деятельности Чан Вай Нун, бывшего советника по инвестициям DBS Bank (Hong Kong) Limited (DBSHK).

Регулятор SFC обнаружил, что в декабре 2015 года Чан переслал список, содержащий персональные данные примерно 208 клиентов из электронной почты в DBSHK на его личную электронную почту.

Раскрытая схема была таковой:
В феврале 2016 года, за два месяца до того, как Чан перешел работать в другой банк, он переслал список клиентов со своей личной электронной почты на электронную почту экс-коллеги, который в то время работал в новом банке, куда Чан собирался перейти. Неназванный коллега Чана затем отправил список клиентов на свою рабочую электронную почту.

Электронная почта, содержащая данные клиентов, была идентифицирована новым работодателем при постоянном наблюдении отдела безопасности за корпоративной электронной почтой.

Поведение Чана нарушало внутреннюю политику DBSHK, Указ о личных данных (конфиденциальности) (PDPO) и Кодекс поведения для лиц, лицензированных или зарегистрированных регулятором SFC.

При принятии решения о наказании, SFC принял во внимание все соответствующие обстоятельства, в том числе раскаяние Чана и признание его неправомерных действий.
